Enforcement of a Custodial Sentence (903) 1. MEASURE IMPLEMENTATION |

2. LEGAL FRAMEWORK |
International legal framework applicable for this measure in your Member State | Council Framework Decision 2009/829 of 27 November 2008 on the application of the principle of mutual recognition to judgments in criminal matters imposing custodial sentences or measures involving deprevation of liberty for the purpose of their enforcement in the European Union. |
3. COMPETENT AUTHORITY TO: |
* receive the request/decision for judicial cooperation | The Attorney General is the competent authority to receive judgments issued in the issuing State and to transmit to the exeucitng State judgments issued in Malta by the courts of criminal jurisdiction. | * execute/recognise the measure (if other than the receiving authority) | As above. |

5. EXECUTION DEADLINE |
Deadlines for the execution of the request/decision (where applicable) | A decision on the recognition of the judgment and the enforcement of the sentence shall be taken within a period of ninety days of receipt of the judgment and the certificate, unless there exists any ground for postponment in terms of Framework Decision 2008/909/JHA. When in exceptional cases it is not practicable for a decision to be taken within this period, the Attorney General shall inform the issuing State giving the reasons for the delay and the estimated time needed for the final decision to be taken.
