Enforcement of a Financial Penalty (902) 1. MEASURE IMPLEMENTATION |
Is this measure possible in your Member State under International Judicial Cooperation? | Yes.
The Framework Decision 2005/214/JHA on the application of the principle of mutual recognition to financial penalties has been implemented in Belgium by the following two laws:
- Law of 19 Mars 2012 amending the law of 5 August 2006 on the application of the principle of mutual recognition of judicial decisions in criminal matters between the member states of the European Union;
- Law of 26 November 2012 amending the law of 5 August 2006 on the application of the principle of mutual recognition of judicial decisions in criminal matters between the member states of the European Union;

2. LEGAL FRAMEWORK |

Accepted languages for the request/decision | The certificate should be should be drawn up in or translated into Dutch, French, German or English.
Important remarks: before the execution, the letter of request will be translated by the Belgian prosecutor if the language is not the language of the judicial area where the letter of request has to be executed. It is recommended, when possible, to obtain previously the information about the correct language. |
