Is this measure possible in your Member State under International Judicial Cooperation?

Yes. Children may be heard during the preliminary investigation. Normally consent from the parents is necessary. If the hearing is to take place in Court, the Court determines whether a person under the age of 15 years may be heard as a witness or not. If a child is to be heard in Court he or she is not heard under oath.

a. Special requirements

In a Swedish pretrial investigation a child under 15 is normally interviewed in a special Child House and the interview is recorded on a DVD. The lawyer of the suspects may be present in a connected room and can put questions to the child via the inteviewer. If a trial follows, the DVD is played in Court instead of having the child present at Court.
