In compliance with domestic legislation (Law 30 September 1993, no. 388), in the case laid down in the last part of Article 41 § 1 of the Convention, the Judicial Police shall check on the identity of the person pursued and arrest them. If the arrested person is not an Italian national, he or she shall be released by the same authority that has carried out the arrest at the latest within the time limit set forth in § 6 of Article 41 of the Convention (6 hours of the arrest without considering the time between midnight and 9 a.m.), when the person has not been arrested for extradition purposes within that same time limit.
