Cross-border hot pursuit (802)

1. MEASURE IMPLEMENTATION

Is this measure possible in your Member State under International Judicial Cooperation?

Yes, it is possible. The member of the foreign authority may - without prior authorisation - continue the pursuit in the territory of Hungary if the person concerned is suspected of having committed or attempted to commit a crime specified at measure 801 in the foreign state's territory and was caught red-handed in the act; or this person was escaped from arrest, pre-trial detention or before the execution of custodial sentence, and the delay caused by notifying the Hungarian law enforcement body would render the arrest of the perpetrator substantially more difficult or severely jeopardise the interests of crime of the foreign state and it is likely that the Hungarian law enforcement body would not be able to take over the pursuit in due time. (See Section 31 of Act No LIV of 2002 on International Cooperation of Law Enforcement Authorities)

a. Special requirements

NEBEK shall be notified immediately by the member of the foreign authority who is carrying out the hot pursuit. The hot pursuit shall cease immediately if so requested by the competent Hungarian law enforcement body. The foreign authority's officer conducting surveillance in the territory of Hungary shall have and carry a document verifying that the observation has been authorised and must be able all the time to prove that he is acting in his official capacity and that he is representing the foreign authority.
