Cross-border observation (801) 1. MEASURE IMPLEMENTATION |
Is this measure possible in your Member State under International Judicial Cooperation? | There is no internal law which governs cross-border co-operation, especially cross-border observation. This subject and all the activities undertaken in this area are therefore governed by the standards of the convention for applying the Schengen Agreement to which Portugal is party. For implementation of this special cross-border policing technique, the competent Portuguese authorities are those appointed in the Membership Agreement for the Republic of Portugal to the convention for applying the Schengen Agreement, namely agents of the criminal investigation department and the General Directorate of the criminal investigation department |
