Is this measure possible in your Member State under International Judicial Cooperation?

Yes. It is provided for in the Probation Act, Chapter 446 of the Laws of Malta.

2. LEGAL FRAMEWORK

International legal framework applicable for this measure in your Member State

Council Framework Decision 2008/947/JHA of 27 November 2008 on the application of the principle of mutual recognition to judgments and probation decisions with a view to the supervision of probation measures and alternative sanctions.

3. COMPETENT AUTHORITY TO:

The Attorney General is the designated central authority compentent to receive decisions on supervision measures issued in the issuing State and to transmit to the executing State decisions on supervision measures issued in Malta by a court of criminal jurisdiction. The courts of criminal jurisdiction are the authority competent to issue decisions on supervision measures.

5. EXECUTION DEADLINE

Deadlines for the execution of the request/decision (where applicable)

60 days of receipt of the judgment and the certificate. If in exceptional circumstances, it is not possible for the court of criminal jurisdiction to comply with the time limit of 60 days, it shall inform the competent authority of the issuing State by any means, giving the reasons for the delay and indicating the estimated time needed for the final decision to be taken.

The Attorney General may refuse to recognise a community sanction issued in another Member State if the sentenced person is not resident in Malta and the sentenced person has returned or wants to return to Malta.
