Is this measure possible in your Member State under International Judicial Cooperation?

Yes. It is provided by the Law on the application of the principle of mutual recognition to judgments and probation decisions with a view to the supervision of probation measures and alternative sanctions (Law No. 69(I)/2014).

2. LEGAL FRAMEWORK

International legal framework applicable for this measure in your Member State

Council Framework Decision 2008/947/JHA of 27 November 2008 on the application of the principle of mutual recognition to judgments and probation decisions with a view to the supervision of probation measures and alternative sanctions.

3. COMPETENT AUTHORITY TO:

The competent authority for the recognition of the judgment issued by an EU Member State, when Cyprus is the executing state, is the District Court in the jurisdiction of which the lawful and ordinary residence of the sentenced person is situated. The competent authority for the supervision of probation measures and alternative sanctions is the competent Ministry, Department or Authority of the Republic, according to the specific case. The Ministry of Justice and Public Order assists the competent authorities of issuing and executing the judgment during the transmission and receipt of the Court Decision and during the official correspondence.

5. EXECUTION DEADLINE

Deadlines for the execution of the request/decision (where applicable)

60 days of receipt of the judgment and the relevant documents. When in exceptional circumstances it is not possible for the competent authority to comply with the time limit of 60 days, it shall immediately inform the competent authority of the issuing State by any means, giving the reasons for the delay and indicating the estimated time needed for the final decision to be taken.

The competent authority of the Republic may consent to the transmission of a probation decision issued in another Member State, only when the sentenced person has his lawful and ordinary residence in the Republic and has returned or wishes to return to the Republic.
