Is this measure possible in your Member State under International Judicial Cooperation? | During investigation:
Questioning of a suspect is possible provided that the normal rules applying to the questioning of suspects are observed. See no. 710 on ‘hearing suspects/person accused’.
During trial:
For the court to allow the accused to partake in the trial via video conference the case must concern; a matter which will only result in prison for a maximum of 1 year, a fine, confiscation, disqualification, default fines or damages, and the presiding judge must find video conference justifiable in regard to upholding the accused’s rights as guaranteed by his or her presence.
