Is this measure possible in your Member State under International Judicial Cooperation? | Yes. Everyone who is not a party in the case may be heard as a witness during the preliminary investigations or before the Court. However, in Sweden the word "witness" is applicable to third parties only. Plaintiffs and victims may still be heard but they are not regarded as witnesses. |
2. LEGAL FRAMEWORK |
International legal framework applicable for this measure in your Member State | In order to obtain this measure from the Court or a prosecutor, an MLA is compulsory. If an interview is to be held pretrial and doesnt need the involvment of a prosecutor (e.g. there is no need of coercive measures), it is possible to do it within the framework of international police cooperation without an MLA. |
