Is this measure possible in your Member State under International Judicial Cooperation?

Yes. A witness can give his testimony directly to the police at the crime scene, or he can be summoned to an interrogation at the police station. He will then be given a writ specifying that he is summoned as a witness, the criminal case for which he is summoned and the time and date for the interrogation. A witness can refuse to give his statement to the police, but he is obliged to respond to the summoning to the court, and he might get a fine if he does not show.

3. COMPETENT AUTHORITY TO:

* receive the request/decision for judicial cooperation

The documents are primarily sent directly by post to the person concerned. If that is not possible, or he does not respond, the documents accompanied by the request are to be sent to the local public prosecutor who has territorial jurisdiction, in accordance with the provisions of MLA article 5.

* execute/recognise the measure (if other than the receiving authority)

The local police will execute the request.

Accepted languages for the request/decision

The documents should be translated into Norwegian, but also English may be accepted. If the requesting State is aware that the person concerned understands only another language, the documents must be translated into this language as well.

5. EXECUTION DEADLINE

Deadlines for the execution of the request/decision (where applicable)

There is no specific deadline foreseen by the Norwegian law for the execution of letters of request. Summonses have to be sent within a reasonable time before the date of the court session.

6. CONCISE LEGAL PRACTICAL INFORMATION

a. Special requirements

Summoning of witnesses will be practically executed in writing. Witnesses are obliged to testify to the Court, but not to the police. In some special cases the witnesses may refuse to give information, e.g. if they are in family with the defendant, or if their testimony will incriminate the witness. Minors/infants (under 18 years) are summoned by their parents/legal representatives.
